Existing workers' compensation law requires employers to secure the payment of workers' compensation, including medical treatment, for injuries incurred by their employees that arise out of, or in the course of, employment. This bill would, for purposes of these provisions, require that these employees be employed on a regular, or full-time basis, but would eliminate the requirement that these employees be members of the Public Employees' Retirement System or the Los Angeles City Employees' Retirement System or subject to the County Employees' Retirement Law of 1937. The bill would provide that the provisions pertaining to a leave of absence shall not apply to certain public safety personnel who are employees of the City and County of San Francisco. By increasing the duties of local officials with respect to the administration of this provision, this bill would impose a state-mandated local program. The California Constitution generally limits ad valorem taxes on real property to 1% of the full cash value of that property. For purposes of this limitation, "full cash value" is defined as the assessor's valuation of real property as shown on the 1975-76 tax bill under "full cash value" or, thereafter, the appraised value of that real property when purchased, newly constructed, or a change in ownership has occurred. The California Constitution authorizes the Legislature to exclude from classification as "newly constructed" the construction or installation on or after November 7, 1984, of any fire sprinkler system, other fire extinguishing system, fire detection system, or fire-related egress improvement, as defined by the Legislature. Existing property tax law implementing this exclusion provides that the exclusion only applies to the construction or installation of these items in an existing building. This bill would provide that this exclusion from "newly constructed" also applies to the construction or installation, on and after the operative date of the bill, of any fire sprinkler system, other fire extinguishing system, or fire detection system in a new building. This bill would also specify, for purposes of this exclusion, that "the construction or installation of any fire sprinkler system, other fire extinguishing system, or fire detection system" includes the construction of any fire sprinkler system, other fire extinguishing system, or fire detection system in a new building , as defined, in which the owner-builder incorporated the fire sprinkler system, other fire extinguishing system, or fire detection system in the initial construction of the building and the owner-builder does not intend to occupy or use the building. This bill would provide this exclusion to the initial purchaser of the new building, but only if the owner-builder did not receive an exclusion for the same system. In the case of a new nonresidential building, this bill would specify that "fire sprinkler system, other fire extinguishing system, or fire detection system" does not include such items that are required by the California Fire Code to be included in the new building. This bill would require the county assessor to reduce the base-year value of these buildings by the value of such items, as specified. This bill would require the State Board of Equalization, in consultation with the California Assessor's Association, to prescribe the manner and form for a taxpayer to claim this exclusion. Existing law sets forth the liability of relatives for the costs of a patient in a state hospital for the mentally disordered. This bill would repeal the provisions setting forth a relative's liability for cost of a patient in a state hospital and would, instead, enact state hospital cost of care liability provisions that are similar to statutory provisions establishing a relative's liability for the costs of services for beneficiaries under the Medi-Cal program. This bill contains other existing laws.

Existing law, the Biennial Inspection of Terminals Program, generally requires the Department of the California Highway Patrol to inspect, at least every 25 months, every terminal of a motor carrier who operates certain vehicles. A terminal that has attained 2 consecutive satisfactory compliance ratings pursuant to those inspections is eligible for administrative review in lieu of the next required inspection, unless specified circumstances apply. The bill would prohibit a motor carrier of hazardous materials from being granted administrative review in lieu of those inspections at any terminal from which specified hazardous materials carrying vehicles are operated. Existing law, the Emergency Medical Services System and Prehospital Emergency Medical Care Personnel Act (EMS Act), establishes the Emergency Medical Services Authority within the California Health and Human Services Agency to, among other things, provide statewide coordination of county EMS programs, and to administer the Trauma Care Fund. This bill would delete from the criteria for local distribution of those funds , consideration of whether the acquisition is demonstrated to be essential for trauma services within a specified hospital and whether coordination or payment of prescribed care and transportation services may be provided as necessary without undue delay . The bill would designate 10% of those funds forreimbursement for out-of-county indigent trauma care patients . This bill contains other related provisions and other existing laws.

The State Fireworks Law requires the State Fire Marshal to adopt regulations relating to fireworks as may be necessary for the protection of life and property, and requires the State Fire Marshal to appoint deputies and employees as may be required to carry out the provisions of that law. That law provides that the State Fire Marshal, his or her salaried deputies, or a chief of a fire department, or his or her authorized representatives, a fire protection agency, or any other public agency authorized by statute to enforce the State Fire Marshal's regulations, may seize any fireworks, as described, and may charge a person whose fireworks are seized with specified costs of transporting, storing, and handling the seized fireworks. That law also makes it unlawful for a person to, among other matters, transport fireworks unless those fireworks have been classified and registered by the State Fire Marshal. This bill would make it unlawful for a person to possess a specified amount of dangerous fireworks, and upon conviction, is guilty of a public offense punishable by a fine or by imprisonment, as specified. By creating a new crime, the bill would impose a state-mandated local program. The bill would require the State Fire Marshal, on or before July 1, 2008, to identify and evaluate specified data relating to fireworks , and require the State Fire Marshal to furnish a copy of the evaluation methods to any interested person upon request . The bill would require the State Fire Marshal, in conjunction with the Attorney General, to send notices regarding unauthorized shipments of fireworks in California, as specified.
