contract with all fees and commissions paid to the agency's insurance broker.

The Cortese-Knox-Hertzberg Local Government Reorganization
Act of 2000 declares the intent of the Legislature that each local agency
formation commission establish written policies and procedures.
Existing law authorizes a commission, through the adoption of the written
policies and procedures, to require lobbying disclosure and reporting
requirements for persons who attempt to influence pending decisions by
commission members, staff, or consultants. This bill would extend this
authority to also permit a commission to require lobbying disclosure and
reporting requirements for persons who attempt to influence those who sign
petitions or vote in elections called under the act or who otherwise attempt
to influence proceedings held under the act.

Existing
law establishes the State Fire Marshal within the Department of Forestry and
Fire Protection and sets forth its duties, including, but not limited to,
administering provisions relating to inspection and approval of fire
protection measures for health and community care facilities. This bill would
require every residential care facility for the elderly that is licensed to
care for not more than 6 residents, to have an approved, operable automatic
fire sprinkler system on and after January 1, 2011, if they are licensed as
of January 1, 2010. The bill would require every facility for which a license
is newly issued on or after January 1, 2010, to have an approved, operable
automatic fire sprinkler system on and after the date of issuance. The bill
would require the State Fire Marshal to adopt regulations to implement these
provisions by January 1, 2009, including addressing those fire safety
features no longer required of a licensee after an operable automatic fire
sprinkler system has been installed and maintained. The bill would also
provide that the landlord shall determine all phases of construction, and the
facility shall pay all costs including permit fees, cost of design and
construction, and tenant relocation costs. The bill would require the State
Fire Marshal to convene a subcommittee of the marshal's advisory committee
and specify matters for the subcommittee to study, and would require the
subcommittee to report to various committees in the Legislature not later
than January 1, 2009. By changing the definition of a crime, this bill would
impose a state-mandated local program. This bill contains other related
provisions and other existing laws.

Summary:

The
County Employees Retirement Law of 1937 authorizes a county to employ,
without reinstatement from retirement, a retired member in a position
requiring special skills or knowledge. Under the law, a retired member may
not work more than 90 working days or 720 hours, in a fiscal year or any
other designated 12-month period, except as specified in Contra Costa
County. The law
authorizes a board of supervisors to extend that reemployment period to
permit a retired member to work up to 120 working days or 960 hours,
whichever is greater, in a fiscal year or any other designated 12-month
period. This bill would provide that the authorizations described above are
inapplicable to a retired member who is employed by an employer under the
system and who, within 12 months prior to that employment, received
unemployment insurance compensation following the termination of an
appointment with the same employer. The bill would require a retired person
who accepts an appointment after receiving unemployment insurance
compensation, as specified, to terminate that employment on the last day of
the current pay period and would prohibit reappointment for a period of 12
months.

Proposition
1B, approved by the voters at the November 2006 general election, enacts the
Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of
2006, which authorizes the issuance of $19.925 billion of general obligation
bonds for various transportation purposes. This bill, with respect to certain
of those bond funds, would require the California Transportation Commission
or the Office of Emergency Services, as the allocating agency, to adopt
guidelines and policies to ensure timely use of these bond funds by requiring
construction on a project to begin no later than December 31, 2012. The bill
would, notwithstanding any other provision of law, provide that applicants
for bond funds allocated by the Office of Emergency Services need not comply
with competitive bidding requirements. The bill would enact other related
provisions. The bill would also make findings and declarations of the
Legislature.

Existing
law authorizes the creation of various state agencies, including, but not
limited to, the State and Consumer Services Agency, the Business,
Transportation and Housing Agency, the California Health and Human Services
Agency, and the Labor and Workforce Development Agency. Under existing law,
the secretary of each agency has the power of general supervision over, and
is directly responsible to the Governor for, the operation of each
department, office, and unit, within the agency. Under existing law, there
are in state government various departments, authorities, and offices,
including, but not limited to, the Department of the California Highway
Patrol, the Department of Forestry and Fire Protection, the Office of the
State Fire Marshal, and the Emergency Medical Services Authority. This bill
would create, on January 1, 2009, the California Public Safety Agency, supervised
by the Secretary of the California Public Safety Agency. The bill would
provide, on January 1, 2011, that the California Public Safety Agency shall
consist of the Department of Forestry and Fire Protection, specified fire
suppression personnel, the Office of the State Fire Marshal, the Office of
Emergency Services, the Office of Homeland Security, the Office of Traffic
Safety, the Department of the California Highway Patrol, specified peace
officer personnel, and the Emergency Medical Services Authority. The bill
would also require, by January 1, 2010, each of these departments, personnel,
offices, and authorities to meet with the secretary and develop proposed
internal organizational structures, as specified. The bill would also make
related legislative findings and declarations.

general, existing law provides that everyone is responsible, not only for the
result of his or her willful acts, but also for an injury occasioned to
another by his or her want of ordinary care or skill in the management of his
or her property or person, except as specified. However, existing law exempts
certain persons who render care in an emergency situation from liability for
civil damages as a result of acts or omissions by that person in rendering
the care. This bill would express the intent of the Legislature to enact
legislation to provide a limited immunity from liability for businesses and
nonprofit organizations that voluntarily, without compensation or expectation
of compensation, provide resources in response to an emergency at the request
of public emergency responders.

Existing
law, the Emergency Medical Services System and the Prehospital
Emergency Medical Care Personnel Act, provides for the certification of
emergency medical technicians through the issuance of certificates, including
EMT-I and EMT-II certificates, by local entities, known as local EMS agencies, which are designated by counties.
Existing law also permits public safety agencies, for public safety
personnel, and the State Board of Fire Services, for fire safety personnel,
to issue EMT-I certificates. Existing law provides that the medical director
of a local EMS agency or the Emergency Medical Services Authority may deny,
suspend, or revoke certificates issued under these provisions, or may place a
certificate holder on probation, upon finding the occurrence of any of
specified events. This bill would make a technical, nonsubstantive
change. This bill contains other existing laws.
