Existing law requires the Regents of the University of California, the Board of Directors of the Hastings College of the Law, and the Trustees of the California State University to excuse the mandatory systemwide tuition and fees of any surviving spouse or surviving child, natural or adopted, of a deceased person who was a resident of the state, who was employed by a public agency, who was a contractor, or who was an employee of a contractor, as defined, whose principal duties consisted of active law enforcement service or active fire suppression and prevention, and who was killed in the performance of those duties. This bill would enact the California Fallen Federal Firefighter Survivor Assistance Act of 2007, which would excuse the mandatory systemwide tuition and fees of any surviving spouse , as defined, or surviving child or stepchild of a deceased firefighter employed by the federal government who was a resident of, and whose regular duty assignment was to perform firefighting services in, this state, upon specified circumstances. The bill would provide that those benefits shall supplement, and not supplant, specified federal benefits, as described, and would make a survivor ineligible for the mandatory tuition and fee waiver if provision of those benefits would result in the reduction or elimination of the above-described federal benefits. Under existing law, an individual who is a member of the Public Employees' Retirement System, the Legislators' Retirement System, the Judges' Retirement System, or Judges' Retirement System II may participate in the Supplemental Contributions Program. Under existing law, that individual may contribute at least a minimum amount to the Supplemental Contributions Program. Existing law requires the Board of Administration of the Public Employees' Retirement System to administer that program and requires employee contributions to be paid to the Supplemental Contributions Program Fund, a continuously appropriated fund. This bill would additionally permit an individual employed by an employer who contracts with the board for the Supplemental Contributions Program to participate in that program. By increasing contributions to a continuously appropriated fund, the bill would make an appropriation. The bill would also make clarifying and technical changes to these provisions.

The California Constitution authorizes private property to be taken or damaged for public use only when just compensation has been paid to, or into court for, the owner of the property. This measure would prohibit the taking or damaging of private property without the express written consent of the owner for purposes of economic development, increasing tax revenue, or private use, or when the same use will be maintained following the taking. The measure would require that, prior to the commencement of eminent domain proceedings, the public use for which the property is to be taken be stated in writing. The measure would provide that a property owner's acceptance of money deposited as the probable amount of just compensation does not prejudice the owner's right to challenge the amount of compensation or whether the taking is for a private use. The measure would entitle a property owner to an award of attorney's fees from the condemnor upon a court finding that the condemnor's actions were not in compliance with the measure's provisions. The measure would define "public use" for these purposes, and would permit the leasing of limited space for privately owned and operated business activity incidental to, and compatible with, the public work or improvement, subject to specified restrictions. The measure would permit private property to be taken to eliminate a specific, recurring, and ongoing threat to public safety, if certain conditions exist on each parcel to be taken, and pursuant to a certain process. The measure would provide that if property taken by eminent domain ceases to be used for the public use stated at the time of the taking, or fails to be put to that use within 10 years following the date of the taking, the former owner and heirs shall have the right to acquire the property at fair market value at the time of the reconveyance. The measure would provide that it applies to both new and pending projects that involve the exercise of the power of eminent domain, except if a resolution of necessity was adopted, as specified, prior to the effective date of the measure. The measure would except from the application of its provisions real property that is within a duly formed redevelopment project as of January 1, 2008, that has a specific connection with a military facility.

The California Emergency Services Act establishes the Disaster Response-Emergency Operations Account in the Special Fund for Economic Uncertainties, and continuously appropriates moneys in the account for allocation by the Director of Finance to state agencies for qualifying disaster response operation costs for specified activities. These provisions are repealed as of July 1, 2007. This bill would extend the repeal date of these provisions to January 1, 2009 . By extending the existence of a continuously appropriated fund, this bill would make an appropriation. This bill contains other related provisions.

Existing law authorizes a school district to enter into a joint-use agreement with another governmental entity that includes some or all of the territory of the district, for specified purposes. This bill would authorize the Chino Valley Unified School District to transfer specified surplus property owned by the school district to the City of Chino Hills, in the County of San Bernardino, upon payment to the district by the city and the execution of an agreement between the school district and the city for development of the property into a park. This bill would further require the property to revert to the school district if the property ceased to be used for parks and recreation purposes. This bill contains other existing laws.

Existing Workers' Compensation Law requires employers to secure the payment of workers' compensation, including medical treatment, for injuries incurred by their employees that arise out of, or in the course of, employment. Existing law declares that it is the policy of this state that there should not be discrimination against workers who are injured in the course or scope of their employment. This bill would require an employer to reinstate an employee to his or her preinjury job within 5 working days after receipt of a written statement by the treating physician that the employee is able to perform the essential functions of the employee's regular position, notwithstanding the risks inherent in the position, without a risk of further injury to the employee due to the effects of the injury or illness, and when the employee is willing and available to return to work. The bill would provide that if the employer refuses to reinstate such an employee to his or her preinjury job, the employer shall be required to reimburse the employee for lost wages and work benefits. The bill would prohibit an employer from requiring an employee to perform additional physical duties that were not required of the employee prior to his or her injury or illness as a condition for returning to employment, unless the additional physical duties are reasonably required to accommodate the employee's disability or the additional physical duties are pr esently being required of the employees in the same class or job assignment as the employee held at the time he or she was injured . The bill would require an employer to reimburse the employee for lost wages and work benefits for any time that the employee is unable to work due to the imposition of additional physical duties that are not reasonably required to accommodate the employee's disability.
